The following Terms of Use ("Terms") constitute a legally binding agreement between Kristy Baumann Nutrition LLC ("Company," "we," "us," or "our") and you ("Client," "you," or "your") governing your purchase of and participation in the "Half Marathon Fueling System" (the "Program"), as well as your use of any related websites, portals, content, materials, and services provided by Company (collectively, the "Company Content").

By purchasing, accessing, or using the Program or Company Content, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not purchase or use the Program.

Company reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting. Continued use of the Program constitutes acceptance of the revised Terms.

PROGRAM DESCRIPTION

The "Half Marathon Fueling System" (the "Program") is a structured, time-limited educational nutrition program designed to support marathon runners with fueling strategies throughout training.

The Program includes educational content delivered over a "fixed 12-week access period" from the date of purchase. Program components may include pre-recorded videos, written materials, worksheets, fueling examples, live or pre-recorded trainings, community access hosted inside Practice Better, and bonus resources.

The Program is educational in nature only and does not include individualized medical or nutrition therapy.

PURCHASE POLICY

Upon purchase, you will receive access to the Program materials delivered electronically.

**Pricing Options** (unless otherwise stated at checkout):

* One-time payment of **$249**, or
* **3 monthly payments of $92**

By selecting a payment plan, you agree to complete all scheduled payments. Failure to complete payment may result in suspension or termination of access, and you remain responsible for all outstanding balances.

Access to the Program is granted for **12 weeks from the date of purchase**, regardless of payment method.

REFUND POLICY

Due to the digital nature of the Program and immediate access to proprietary materials, the following refund policy applies:

* You may request a **full refund within 7 days of purchase**, provided you have not completed more than a minimal portion of the Program materials.
* After 7 days, **all sales are final and non-refundable**, including payment plans.

If you are on a payment plan, you remain responsible for all remaining payments after the refund window closes.

ACCESS & TERMINATION

Your access to the Program will automatically expire **12 weeks from the date of purchase**.

Company reserves the right to revoke or terminate your access without refund if you:

* Violate these Terms;
* Share login credentials or Program materials;
* Engage in disruptive, abusive, or unlawful behavior; or
* Misuse the Company Content.

LICENSE FOR USE OF PROGRAM MATERIALS

Your purchase grants you a **limited, non-transferable, non-exclusive license** to access and use the Program materials for your **personal, non-commercial use only**.

You may not:

* Share, sell, reproduce, distribute, or publicly display Program materials;
* Allow others to access your account;
* Use the materials to create competing products or services.

Unauthorized use constitutes intellectual property infringement and may result in legal action.

DISCLAIMER OF RESULTS

You understand and agree that Company makes **no guarantees** regarding race performance, finish times, health outcomes, or results of any kind.

The Program includes a **live monthly 60-minute group Q&A**, which is educational in nature and does not constitute individualized advice. Attendance is optional and not guaranteed to be recorded.

Individual results vary based on training consistency, health status, and personal circumstances. Company is not responsible for your training or racing decisions.

All nutrition and wellness information provided in the Program and Company Content is for **educational and informational purposes only**.

The Program:

* Does not provide medical advice;
* Does not diagnose, treat, or prevent any disease or condition;
* Does not replace advice from your physician, registered dietitian, or other licensed healthcare provider.

You agree to consult your healthcare provider before making changes to your diet, supplement use, or training.

ASSUMPTION OF RISK & WAIVER

You acknowledge that making changes to nutrition, fueling, supplements, or training involves inherent risks. You voluntarily assume all risks associated with applying information from the Program.

You release and hold harmless Company from any claims arising from your participation in the Program.

INTELLECTUAL PROPERTY

All Company Content is owned by Kristy Baumann Nutrition LLC or licensed to Company and is protected by U.S. and international copyright and trademark laws.

No ownership rights are transferred to you.

PROHIBITED USES

You agree not to:

* Copy, scrape, or reverse engineer the Program or Website;
* Upload viruses or malicious code;
* Use the Program for unlawful or unauthorized purposes;
* Harass or disrupt other participants or Company representatives.

COMMUNITY & USER CONDUCT

The Program includes access to a private community hosted inside Practice Better. This community is intended to provide peer support and general education.

You agree to engage respectfully. Harassment, hate speech, spam, solicitation, or illegal activity will not be tolerated and may result in immediate removal from the community and Program without refund.

Company reserves the right to moderate or remove content at its sole discretion.

AFFILIATE DISCLOSURE

Company may recommend products or services via affiliate links. Company may receive a commission at no additional cost to you. All affiliate relationships are disclosed in accordance with FTC guidelines.

THIRD-PARTY LINKS

These Terms shall be governed by the laws of the State of Minnesota.

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association in or near Washington County, Minnesota.

MISCELLANEOUS

* If any provision is deemed unenforceable, the remaining provisions shall remain in effect.
* These Terms constitute the entire agreement between you and Company.
* Company may assign these Terms without restriction.
